Second: Licensing procedures in accordance with federal laws in the UAE:

The order of departments differs with the type of company for which the license is required.

Trade companies:
Department of Economic Development to obtain trade name
Ministry of Justice, civil court, to attest the partnership contract in accordance with the legal form shown in the trade name, provided that it is a legal form specified in the company law
Department of Economic Development in Sharjah for commercial registration
Department of Economic Development for completing licensing procedures: inspection of the establishment’s site, completing required documents for the licensing section including the rent contract, partnership contract and the receipt of fee payment for the ministry’s special bulletin
Presenting a photocopy of the license of the Department of Economic Development to the Sharjah Chamber of Commerce and Industry, and applying for the Chamber’s membership

Industrial Companies:
Preliminary approval from the industrial section of the Department of Economic Development
Obtaining the trade name from the Department of Economic Development
Attesting the company’s contract from the Ministry of Justice (Civil Court) in the case of limited liability company or any individual company form
Completing licensing procedures and obtaining the license from the Department of Economic Development
Presenting a photocopy of the department’s license to the Sharjah Chamber of Commerce and Industry and applying for the chamber’s membership

We would like to mention here that industrial activity requires special specifications in the premises of the establishment. That is why the Department of Economic Development should be consulted before signing the rent contract so that the investor is enlightened on the appropriateness of the site.

After completing the licensing process, a license is obtained and is presented to the Ministry of Economy and Commerce to be published in the companies’ special bulletin on trade and industrial firms.

An industrial license is obtained from the Ministry of Industry.

Licensing procedures in each department in the Sharjah Emirate:
First: Preliminary Approvals (mentioned earlier)
Sec : Procedures to Endorse the Trade Name at the Department of Economic Development

The conditions are as follows:
Applicant’s full capacity
The applicant should not be less than 21 year (in case he is younger, a permission should be obtained from the civil court)
 
Conditions regarding the trade name of the establishment:
Trade name should indicate the activity and the type of products or services
Avoid scientific names that have consumer items or services in the market, or certain brands that have agents, unless in the case where the application is for a company branch
 
Required documents include photocopies of:
Passport photocopy that shows all passport details and the residence visa
The valid license issued to the investor in the UAE with the valid membership certificate from a chamber of commerce and industry
No objection letter from the current sponsor, approved by a chamber of commerce and industry or the court
All activities that need preliminary approval from the licensing section at the Department of Economic Development

Third: Procedures to obtain the License and Commercial Registration at the Department of Economic Development in Sharjah:

The Department of Economic Development has the responsibility of registering trade and industrial establishments operating in Sharjah and of approving applications to open branches of foreign companies. The procedures are as follows:

Required documents include photocopies of:
Obtaining preliminary approval and trade name (mentioned in detail earlier)
Technical evaluation
Attestation of the rent contract
Approval of the advertising board
Attestation of legal contracts
 
Legal contracts, preliminary approval and aforementioned documents must be approved by the Legal Affairs Section or the notary public at the Department of Economic Development
A bank deposit letter should be submitted with the documents to obtain the company license (LLC) besides the trade name. The amount must not be less than AED150,000
